The General Terms and Conditions (GTC) govern the legal relationship between the member on the one hand and IMPACT Martial Arts AG, Josefstrasse 92, 8005 Zurich, on the other hand (hereinafter referred to as "IMPACT"). The member acknowledges that changes to the GTC are reserved. Changes to the GTC will be communicated to the members in a timely and appropriate manner.
IMPACT offers group training, personal training, or seminars. IMPACT offers various subscriptions and services in this regard. The offers and their prices depend on the selected membership. The membership is personal and non-transferable.
IMPACT offers the subscriptions "Membership 1 to 5+" and "Membership 10-Card". There is the possibility of upgrading an existing "Membership 1 to 4" subscription, whereby the current contract is terminated, and a new contract is concluded afterward.
The "Membership 1 to 5+" subscriptions with a contract period of at least six months can be concluded as a one-time payment or as monthly installments. For monthly installments, the monthly fee must be paid until the end of the term. Non-use of the training service does not exempt from further monthly payments until the contract is properly terminated.
The "Membership 1 to 5+" subscriptions with a contract period of at least six months can be interrupted for one to three months (per contract year). This must be communicated in writing via email to support@impact-martialarts.com before the start of the interruption. The billing continues normally. The paused period is credited at the end of the contract term free of charge. In case of non-use, there is no entitlement to it.
In the event of a valid reason on the member's side (illness, pregnancy, accident, military service, long-term stay abroad, further education, relocation) that interrupts training for at least three months, the contract may be extraordinarily terminated.
The member has no right to compensation or a refund of the paid amount if IMPACT is unable to provide its services for reasons beyond its control (force majeure, epidemic, pandemic, etc.). If services cannot be provided for at least one month, the contract period is extended accordingly.
Members can upgrade to a higher membership during their contract period.
The current contract is canceled upon upgrading.
A new contract for the upgraded membership begins immediately.
Remaining obligations from the old contract are settled.
If a one-time payment was made for the old contract, the remaining balance is credited to the new contract.
New membership fees apply from the start date of the new contract.
Members cannot downgrade to a lower membership during the active contract period.
Downgrades can be requested when the contract is up for renewal, subject to standard notice periods.
Participation in training is subject to the following requirements:
1. Fitness: The member is responsible for assessing their own fitness. Injuries and physical or mental impairments must be reported to the head trainer no later than before the start of the training. By participating, the member confirms that they are in good health.
2. Safety and consideration: The member is considerate of others and acts to ensure everyone's safety. Participation under the influence of drugs is not allowed.
Participation is prohibited for members with symptoms of illness, suspected infection with communicable pathogens, and/or a (official or self-imposed) quarantine. The risk of infection cannot be completely excluded even with hygiene rules. IMPACT excludes all related liability.
With a "Membership 1 to 4" subscription, the member can participate in the corresponding number of training sessions per week within their category (gender and level) flexibly, without being tied to specific days and times. If the full number of sessions is not used within a week, the weekly allowance expires and restarts on Monday.
With a "Membership 5+" subscription, the member can participate in all training sessions of their category (gender and level) in any number.
With a "Membership 10-Card", the member can participate flexibly in the corresponding number of training sessions within their category (gender and level) per week. One point is deducted from the 10-Card for each session used. After 10 sessions, the subscription expires. Unused sessions expire six months after the contract starts.
The member acknowledges and accepts that the studio is closed for holidays in calendar weeks 31 and 32 in August and calendar weeks 52 and 1 in December, as well as on public holidays in the Canton of Zurich. The monthly fee for subscriptions remains unaffected.
The member agrees that audio, image, and video recordings may be made during training. These recordings may be used by IMPACT for internal purposes and marketing (website, Instagram, Facebook, TikTok, LinkedIn, etc.).
The member can refuse audio, image, or video recordings involving them by sending a written email when signing the contract. In case of refusal, no recordings will be made, or existing ones will be deleted.
To the extent legally permissible, IMPACT excludes all liability for direct and indirect damages. Participation in IMPACT's offers, particularly in courses, is at the member's own risk. Obtaining insurance is the responsibility of the member.
IMPACT is not liable for the loss of effects, valuables, money, clothes, etc.

The member is obliged to follow the instructions of the staff. In the case of serious or repeated violations of the staff's instructions, IMPACT is entitled to issue a written warning and, in the case of further violations, to impose a house ban and terminate the contract immediately. The member has no contractual claim for reimbursement.
The processing of personal data in connection with IMPACT's subscriptions is subject to a separate privacy policy. The privacy policy is available online at www.impact-martialarts.com. By entering into a contract, the member accepts the associated processing of their personal data.
These GTC and the subscriptions concluded under them are governed exclusively by substantive Swiss law, with the exclusion of conflict-of-law rules under international private law.
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the subscriptions is Zurich, Switzerland.
